DailyFolio
Our Respect for Intellectual Property
DailyFolio respects the intellectual property rights of others and expects the same from our users. This policy explains how copyright holders can submit a takedown notice, how accused users can respond, and the steps we take to comply with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent international copyright protection laws.
DailyFolio hosts content from three primary sources: (a) AI-generated stories produced by our platform, (b) original works submitted by registered users through the WriteBook feature, and (c) AI-generated illustrations and audio. Despite our safety filters, editorial review process, and content moderation, we acknowledge that infringing material may occasionally appear on our platform, and we act promptly to address it.
1. Submitting a Copyright Infringement Notice (DMCA Takedown)
If you are a copyright owner (or authorized agent of one) and believe that content on DailyFolio infringes your copyright, please send a written notice to our Designated Copyright Agent at:
DailyFolio — Designated Copyright Agent
Email: dmca@dailyfolio.org
Please use the subject line: "DMCA Takedown Notice"
To be valid, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- A clear identification of the copyrighted work you claim has been infringed (e.g., title, author, ISBN, publication date, URL to the original work).
- A clear identification of the infringing material on DailyFolio — including the exact URL(s) (e.g., https://dailyfolio.org/BookDetails?id=XXX) so we can locate and remove it.
- Your full contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Incomplete notices may be rejected. Knowingly submitting a false or misleading DMCA notice may expose you to liability for damages under 17 U.S.C. § 512(f).
2. What Happens After We Receive a Valid Notice
Upon receiving a valid and complete DMCA notice, we will:
- Remove or disable access to the allegedly infringing content, typically within 24–72 hours.
- Notify the user who posted or is associated with the content that it has been removed.
- Provide the user with a copy of the takedown notice and inform them of their right to file a counter-notice.
- In cases of repeated infringement, terminate the account of the user in accordance with our Repeat Infringer Policy (see Section 4).
Removal does not constitute an admission of liability and does not waive any claim or defense.
3. Counter-Notice — If Your Content Was Wrongly Removed
If you believe that your content was removed by mistake or as a result of misidentification, you may file a counter-notice by emailing dmca@dailyfolio.org with the subject line "DMCA Counter-Notice" and the following information:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it previously appeared.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel (or, if you are in the U.S., the federal district court for your judicial district), and that you will accept service of process from the party who filed the original notice.
After we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant files a lawsuit within 10–14 business days, we may, at our discretion, restore the removed content.
4. Repeat Infringer Policy
In accordance with the DMCA and our Terms of Service, we maintain a strict policy toward repeat copyright infringers. Accounts that receive multiple valid DMCA takedown notices may be:
- Restricted from publishing new content or submitting stories.
- Permanently suspended or terminated without refund.
- Blocked from creating new accounts on the platform.
We reserve the right to terminate any account at our sole discretion in response to repeat infringement, regardless of whether formal DMCA notices were filed.
5. AI-Generated Content & Unintentional Similarity
DailyFolio generates much of its content using artificial intelligence models. While we implement safety filters and content checks, AI systems are trained on large datasets and may, on rare occasions, produce text or imagery that unintentionally resembles existing copyrighted works.
If you believe AI-generated content on our platform resembles your copyrighted work, please submit a DMCA notice as described above. We will treat such notices with the same seriousness as notices regarding user-submitted content and act promptly to remove or modify the material.
Note: Ideas, themes, genres, tropes, and general story structures are not protected by copyright. Only specific expression (exact text, distinctive characters, unique plot elements) can be subject to copyright claims.
6. Trademark Complaints
If you believe your trademark rights are being infringed on DailyFolio (for example, in a book title, character name, or brand reference), please email us at dmca@dailyfolio.org with the subject line "Trademark Complaint" and include proof of your trademark registration, the allegedly infringing material, and contact details.
7. Our Role as a Hosting Platform
DailyFolio acts as a hosting platform for user-submitted and AI-generated content. As an online service provider, we are protected by the "safe harbor" provisions of the DMCA (17 U.S.C. § 512) and equivalent provisions under Israeli and European copyright law, provided we respond promptly to valid takedown notices and maintain the policies described here.
We do not pre-screen all content for copyright compliance, but we act in good faith to remove infringing material when notified and to terminate repeat infringers.
8. False Claims Warning
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Do not submit a DMCA notice unless you are the copyright owner or legally authorized to act on their behalf, and you have a good-faith belief that the use is not authorized.
