By accessing, registering for, or using DailyFolio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not use our services. DailyFolio provides digital books and interactive stories created primarily using artificial intelligence (AI).

2. 年齢制限と監督

While DailyFolio offers content for children, the creation of accounts and purchases must be made by adults (18 years or older).

• Parents or legal guardians are solely responsible for supervising their minors' use of the site and ensuring the content accessed is age-appropriate.

• DailyFolio shall not be held liable for minors' exposure to inappropriate content, as AI-generated content can occasionally be unpredictable despite our strict safety filters.

• 無保証: We make no warranties regarding the accuracy, reliability, logic, or appropriateness of the AI-generated text or images. Content may sometimes be nonsensical, inaccurate, or unintentionally inappropriate.

4. 知的財産権およびライセンス

• 生成コンテンツの所有権: All rights, title, and interest in the AI-generated books, including text, illustrations, and audio, are owned by DailyFolio. We grant active subscribers a limited, non-exclusive, non-transferable, personal license to read and interact with the content on our platform.
• ユーザー入力: By submitting prompts, ideas, or feedback, you grant DailyFolio a worldwide, royalty-free, perpetual license to use, reproduce, and generate derivative works based on your inputs.
• 制限事項: It is strictly forbidden to scrape, copy, duplicate, distribute, sell, publicly display, or create derivative works from DailyFolio's content without express written permission. Commercial use is explicitly prohibited.

4a. ユーザー投稿ストーリーおよびコミュニティコンテンツ

DailyFolio allows registered users to submit their own story ideas via the WriteBook feature, to "love" (like) books, and to post comments on books in the community.

• DailyFolioへのライセンス許諾: By submitting a story, comment, or any other content, you grant DailyFolio a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, reproduce, modify, publish, and display that content on the platform.
• ユーザーの責任: You represent that any content you submit is original, does not infringe on third-party rights, and does not contain hateful, violent, sexual, defamatory, or otherwise harmful material.
• Moderation: All user-submitted stories pass through our editorial review process before publication. Comments and likes are subject to automated and manual moderation. We reserve the right to remove any content at our sole discretion and without notice.
• Community Conduct: You agree not to harass, impersonate, or abuse other users. Violations may result in immediate content removal, account suspension, or permanent ban without refund.

4c. Community Speech, Conduct & Enforcement

DailyFolio is a family-friendly platform that serves readers of all ages, including children. We hold community speech and conduct to a high standard. The rules below apply to every form of expression on the platform — including comments, reviews, submitted stories, author aliases, profile content, feedback messages, and any interaction with our AI agents.

Prohibited speech and behavior

You agree NOT to post, submit, or transmit any content or engage in any behavior that:

• Contains profanity, vulgarity, slurs, or sexually explicit language.
• Is hateful, discriminatory, racist, sexist, homophobic, transphobic, ableist, or targets any group or individual based on identity, religion, nationality, or background.
• Harasses, bullies, intimidates, threatens, shames, or stalks another user, author, or staff member.
• Contains violent, graphic, disturbing, sexual, or otherwise age-inappropriate material — especially given that minors use this platform.
• Impersonates another person, uses a misleading author alias, or falsely represents affiliation with DailyFolio or any third party.
• Promotes self-harm, suicide, eating disorders, drug use, gambling, weapons, illegal activity, or dangerous behavior.
• Spreads misinformation, conspiracy theories, or deliberately false claims presented as fact.
• Contains spam, advertising, solicitations, referral links, phishing attempts, malware, or repetitive/automated content.
• Infringes copyright, trademark, privacy, or any other third-party right.
• Reveals personal information (yours or anyone else's) — including phone numbers, addresses, emails, or financial data.
• Attempts to manipulate, jailbreak, exploit, or reverse-engineer our AI systems or moderation tools.
• Organizes brigading, review-bombing, coordinated downvoting, or any attempt to game leaderboards, likes, or rankings.
• Shows disrespect, sarcasm directed at other users, condescension, or a generally hostile tone — even if no specific rule is broken.

Tone standard & mutual respect

We expect all communication on DailyFolio to be respectful, kind, constructive, and age-appropriate. Criticism of books or other users' work is welcome only when delivered thoughtfully and without personal attacks. If in doubt, imagine a 7-year-old reading your words — if it wouldn't be appropriate for them, don't post it.

Respect other members of the community. Every person on DailyFolio — whether a reader, a young author, a parent, or a staff member — deserves to be treated with dignity, patience, and good faith. You agree to:

• Honor others' creative work, even when you disagree with it or don't enjoy it.
• Assume good intent before reacting — especially toward younger users and first-time authors.
• Celebrate diversity of voices, backgrounds, languages, ages, and skill levels within the community.
• Never mock, belittle, or publicly shame another user's story, alias, avatar, or comment.
• Give feedback the way you'd want to receive it — privately when possible, gently when public, and always with the goal of lifting the other person up rather than tearing them down.
• Acknowledge that this is a shared creative home, and the tone you bring shapes it for everyone else.

Our enforcement rights — at our sole and absolute discretion

You acknowledge and agree that DailyFolio has full, unilateral, and absolute discretion to enforce these rules. Without prior notice, warning, explanation, or obligation to justify our decision, and without any right to refund or compensation, we may:

• Remove, hide, edit, or delete any content you have posted — including comments, reviews, stories, likes, profile fields, or avatars.
• Reset or change your author alias if we deem it misleading, offensive, or inappropriate.
• Force your profile back to private or permanently disable your public profile.
• Disable your ability to comment, like, submit stories, or use specific features.
• Issue a warning, a temporary suspension, or a permanent ban from the platform.
• Terminate your account entirely and cancel your subscription without refund.
• Block your IP address, device, or any future accounts associated with you.
• Report violations to law enforcement or regulatory authorities when legally required or when we believe safety is at risk.
• Preserve logs, messages, and account data as evidence of violations even after account deletion, to the extent permitted by applicable law.

No right to appeal or explanation: Our moderation decisions are final. We are not obligated to disclose which specific rule was violated, to provide evidence, to engage in debate, or to reinstate removed content or banned accounts. We may enforce these rules based on a single incident or a pattern of behavior, and we may do so proactively (based on AI detection or staff review) or reactively (in response to user reports).

Liability: You are solely responsible for everything you post or communicate on DailyFolio. You agree to hold DailyFolio, its founders, staff, affiliates, and other users harmless from any claims arising from your speech or behavior on the platform.

Changes without notice: We may update, expand, or tighten these community rules at any time and without advance notice. Continued use of the platform constitutes acceptance of the current rules.

4b. Public Community Profile

DailyFolio offers an optional public profile feature. By enabling the "Public Community Profile" toggle in your Settings, you agree that:

• Your display name (author alias or full name), avatar, the books you've created, and the books you've loved will be visible to all registered users.
• Your profile may appear in community leaderboards, the members directory, and activity feeds.
• You can revert to a private profile at any time via Settings, which will remove you from public community views going forward.
• Your email address is never displayed publicly.

5. Subscription, Payments, and Cancellations

• Recurring Billing: Subscriptions renew automatically. You authorize us to charge your payment method on file on a recurring basis.
• Cancellation: You may cancel your subscription at any time via your account settings. Access remains active until the end of the current billing cycle.
• 14-Day Cancellation Right: In accordance with the Israeli Consumer Protection Law (חוק הגנת הצרכן), you may cancel your subscription within 14 days from the date of the transaction and receive a full refund, subject to applicable conditions. Refunds are processed within up to 14 business days to your original payment method.
• Beyond 14 Days — Goodwill Refunds: Even after the statutory 14-day window, we handle refund requests fairly and without bureaucracy. Most reasonable requests are approved at our discretion. See our full Refund Policy for details.
• Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice or refund, if we determine you have violated these Terms or abused the Service.

6. Limitation of Liability

To the maximum extent permitted by applicable law, DailyFolio, its founders, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (A) your access to or use of or inability to access or use the service; (B) any conduct or content of any third party or AI models on the service; or (C) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless DailyFolio and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of any term of these Terms of Service.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time without direct notice. We will update the "Last Updated" date at the top of this page. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel.

9a. Copyright Infringement & DMCA

DailyFolio complies with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws. If you believe that content on our platform — whether AI-generated or user-submitted — infringes your copyright, please submit a takedown notice as described in our full DMCA & Copyright Policy. We respond to valid notices promptly and enforce a strict repeat-infringer policy.
